Montana defines the job in the statute itself. A noncommercial registered agent is "an individual or a domestic or foreign entity that serves in this state as the agent for service of process of an entity," per MCA § 35-7-102. Every LLC in the state must have one, or a commercial equivalent, at all times. This page walks the statutory requirements, the address rule, and the two ways to fill the role.
Rather than writing its own agent law, Montana enacted the uniform Model Registered Agents Act as MCA Title 35, chapter 7 (§§ 35-7-101 to 35-7-117). Appointments happen under § 35-7-105, and the state keeps a roster of professional providers under § 35-7-106. One practical upshot of the uniform act: "registered agent" is the official Montana term, with no statutory-agent or resident-agent variants to translate.
Section 35-7-104 requires filings to give an actual street address, or a rural route box number, located in Montana. A bare PO box does not meet the statute. The address matters because it is where a process server shows up when the company gets sued, so whoever is listed needs to actually be present there during ordinary business hours.
